Who these terms are between
These terms ("Terms") are an agreement between you and Trimultaneously, LLC ("Trimultaneously," "we," "us," or "our") and govern your use of the website at trimultaneously.com and any related content, tools, and services we make available through the Site (collectively, the "Site"). They do not govern paid engagements — those are governed by a separate written master services agreement ("MSA") and statement of work ("SOW").
Accepting these terms
By accessing or using the Site you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.
What the Site is for
The Site is an information resource for small business owners and prospective clients. Content on the Site — articles, frameworks, the Growth Audit, case studies — is for general informational purposes only. Nothing on the Site constitutes legal, financial, tax, medical, or investment advice, and nothing on the Site creates a client relationship between you and Trimultaneously.
Booking a call, submitting a form, or subscribing
Booking a Growth Clarity Call, submitting the contact form, taking the Growth Audit, or subscribing to The Operator's Brief does not create a contractual relationship with us. A client relationship begins only when both parties have signed an MSA and an applicable SOW.
Acceptable use
You agree not to:
- Use the Site for any unlawful purpose.
- Scrape, harvest, or copy content for commercial redistribution without our written permission.
- Reverse engineer, decompile, or attempt to derive the source code of any part of the Site.
- Interfere with the Site's security, availability, or integrity.
- Impersonate another person or misrepresent your affiliation.
- Use automated means to access the Site at a rate that disrupts service.
Our intellectual property
The Site — including its text, graphics, design, layout, code, and the Trimultaneously name and marks — is owned by Trimultaneously, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and download materials for your personal, non-commercial reference, but you may not reproduce, distribute, modify, or publicly display them without our written permission.
Open downloadable resources we offer (e.g., the 90-Day Growth Roadmap template) are licensed for your own business use. They are not licensed for resale, rebranding, or redistribution.
Your content
If you submit content to the Site — comments, form responses, audit answers, or anything else — you grant us a non-exclusive, royalty-free license to use it to operate, improve, and promote the Site and Services, subject to our Privacy Policy. You represent that you have the right to submit it and that it doesn't violate anyone else's rights.
Third-party links and services
The Site may link to third-party websites or embed third-party services (e.g., Cal.com for booking). We don't control those third parties and aren't responsible for their content, terms, or practices.
Disclaimers
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any specific outcome will result from following content on the Site.
Limitation of liability
To the maximum extent permitted by law, Trimultaneously and its officers, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or business opportunities, arising out of or in connection with your use of the Site. Our total aggregate liability arising out of or relating to the Site is limited to $100 USD.
Liability under any paid engagement is governed by the MSA and SOW, not by these Terms.
Indemnification
You agree to defend, indemnify, and hold Trimultaneously and its officers, employees, contractors, and partners harmless from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason — including suspected violation of these Terms. Sections of these Terms that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.
Governing law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflicts of law principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the jurisdiction and venue of those courts.
Changes to these Terms
We may update these Terms from time to time. The "last updated" date at the top reflects the most recent revision. Material changes will be highlighted on the Site. Your continued use of the Site after changes become effective constitutes your acceptance of the revised Terms.
